DCIS Website Terms of Use
This Terms of Use (ToU) policy outlines the rules and guidelines to balance the goals outline in the DCIS Charter with the rules under which this 501(c)(3) organization provides the legal and intellectual property protection of the DCIS content. Visitors to this website are granted a license to view this content, but you may not reproduce, distribute, or use the content in any other way without prior written consent from a current officer of DCIS.
Introduction and Acceptance (The Agreement)
(a) Agreement and Consent: By accessing and using this website, the user agrees to be bound by the Terms of Use, which constitutes a legal agreement between the user and DCIS (a 501(c)(3) organization).
(b) Incorporation of Policies: Inclusive of the DCIS Privacy Policy, Code of Conduct, and the Online Donation Policy.
(c) Changes to Terms: DCIS reserves the right to modify these terms at any time, with continued use constituting acceptance of the revised terms.
Intellectual Property and Use of Content (Core Mission)
(a) Ownership: All Materials, Content, Images, Graphics, Text, Video, Sound and Documentation (collectively, the “Content”) are the exclusive property of DCIS or are licensed to DCIS with permission from the original owner/artist/scientist.
(b) Limited Non-Commercial Use (Fair Use): Grants users a revocable, limited, non-exclusive license to download, copy, and print Content solely for personal, non-commercial, educational , and research use, provided attribution is always included.
(c) Prohibited Commercial Use: Expressly prohibits the reproduction, distribution, transmission, broadcasting, selling or exploitation of any Content for commercial purposes, including use in advertisements, publications, or for personal gain, without the prior written permission of a current DCIS officer and licensing (which may include fees).
(d) Trademarks: Prohibits the unauthorized use of DCIS’ name, logo and registered trademarks.
User Conduct and Prohibited Activities
(a) Lawful Use: This website shall only be used for lawful purposes and comply with all applicable local, state, and federal laws.
(b) Prohibited Content: DCIS prohibits the posting, uploading or sharing of any Content that is:
- Defamatory, harassing or hateful
- Violates the intellectual property rights of any third party
- Contains advertising, spam or unsolicited promotions
Disclaimers and Limitations of Liability (Legal Protection)
(a) Disclaimer of Warranty: This website and its Content are provided “AS IS” without warranties of any kind, either explicit or implies, such as accuracy, reliability, or fitness for a specific purpose.
(b) Limitations of Liability: DCIS’ liability for any damages (direct, indirect or incidental) resulting from the use or inability to use this website are limited to one US dollar.
(c) Indemnification: The user of this website shall indemnify and hold DCIS harmless for any claims or costs resulting from any claims or costs resulting from the user’s violation of this Terms of Use .
Online Transactions and Donations
(a) Donations: DCIS is a 501(c)(3) nonprofit organization and all electronic donations are processed by a third party. Refunding of electronic donations are DCIS’ sole discretion.
(b) Jurisdiction and Governing Law: This agreement is governed by the laws: of the Commonwealth of Pennsylvania and all legal disputes must be resolved by local court system.
